Should a court strike down, either temporarily or permanently, any terms or provisions of these policies and procedures, Pacific Bible College reserves the right to make immediate modifications to the policies and procedures that take effect upon publication on our website. Title IX states as follows:. No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance.
Title IX prohibits sex discrimination in both the educational and employment settings. VAWA and the Save Act addresses sexual violence in the form of sexual assault including rape, fondling, statutory rape and incest, Intimate Partner Violence including domestic violence, dating violence and stalking. It is important that this policy be well understood by all members of the PBC community.
The Title IX Coordinator is responsible for the implementation and administration of the policy. This policy applies broadly to the entire College community, including students on-line and on-ground; those employed by the College, including all faculty members, and all staff positions exempt, non-exempt, senior administrative and leadership positions as well as adjuncts, term positions, contractors, vendors or other third parties contractually obligated to the College and alumni, visitors or guests including prospective students or employees.
These definitions are solely for the purposes of this policy and the processes for resolving reports under this policy and do not apply to any other College policy. The term Education Program or Activity includes all College operations, including locations, events, or circumstances over which the College exercised substantial control over both the Respondent and the context in which the conduct occurs; and any building owned or controlled by a student organization that is officially recognized by the College.
The Title IX regulations, which direct the College response, do not draw a line between on campus, off campus, or online, provided the conduct occurred in an Education Program or Activity in the United States. Examples include College-sponsored, College-funded or otherwise College-supported study off campus, research, internship, mentorship, summer session, conferences, meetings, social events, or other affiliated programs or premises.
